Conditions to check before extending
Confirm each of the following applies to your proposed extension:
- The extension is to the rear of the house, not forward of the front or side-facing-a-road walls
- Combined with any previous extensions, the total added floor area is 40 m² or less
- The extension is single-storey, or meets the stricter two-storey conditions if not
- Height limits are respected, including reduced limits near a boundary
- At least 25 m² of private open space remains to the rear of the house
- The house is not a protected structure or within an architectural conservation area
- No planning condition on an earlier permission removes the exemption
Because the 40 m² allowance is cumulative over the life of the house rather than per project, always check what has already been built before assuming the full allowance is available.
When to check with the council
If your house has already been extended, sits in a terrace, is close to a boundary, or has any special planning designation, it is worth applying for a section 5 declaration from your local authority before starting work. This gives a binding answer and avoids the risk of building an unauthorised structure that could complicate a future sale.
