An opinion on compliance is a professional statement by an architect, engineer or building surveyor that, based on periodic inspection, the works substantially comply with planning permission and the building regulations. It is the conveyancing document used for works outside the statutory certification regime.
Two separate opinions are usually issued: one on compliance with planning permission, confirming the building matches the permitted drawings and conditions, and one on compliance with building regulations.
An opinion is qualified. It is based on visual inspection at intervals rather than continuous supervision, and it will list assumptions and exclusions. Solicitors check that the author holds professional indemnity insurance and that the opinion is in an accepted form.
