Checklist for an exempt garden office
Run through these before you build or before changing how it's used:
- It sits to the rear of the house, not the front garden
- Floor area is 25 m² or less, combined with other Class 2 structures
- It is used only by household members, not employees or clients
- No sleeping or permanent living accommodation is included
- At least 25 m² of private open space remains in the garden
- The property is not a protected structure or in a conservation area
Insurance, electrical certification and Building Regulations compliance for insulation and fire safety still apply to an exempt garden office, even without a planning application.
When the use tips into needing permission
If your work involves regular visitors, signage, or employing staff on-site, treat the structure as a change of use and apply for planning permission, since local authorities do act on enforcement complaints about garden offices operating as full commercial premises.
