Do I need planning permission for solar panels in Ireland?

Usually not for standard roof-mounted domestic solar panels, which are exempted development under the micro-generation classes of Schedule 2 to the Planning and Development Regulations 2001, subject to limits on projection from the roof, total area, and restrictions near protected structures and airports.

Following amendments to the Planning and Development Regulations 2001 aimed at encouraging renewable energy uptake, most roof-mounted solar photovoltaic and solar thermal panels on a house are exempted development, provided the panels do not project substantially above the roof plane and the total panel area stays within the percentage-of-roof limits set out in the relevant class.

Ground-mounted solar panels in a garden are also capable of being exempted development, generally subject to a maximum surface area, a requirement to be sited within the curtilage, and set-back distances from the boundary, but the conditions are more restrictive than for roof-mounted panels because a ground array has a greater visual impact.

The exemption is more limited, or removed altogether, for protected structures, structures in architectural conservation areas, and installations close to certain aerodromes or covered by specific local restrictions, so those situations should always be checked individually rather than assumed to be exempt.

Checklist before installing solar panels

Confirm these points with your installer or the council:

  • Panels are roof-mounted and do not project significantly beyond the roof surface
  • Total panel area stays within the percentage limits set for the relevant roof class
  • For ground-mounted arrays, the size and boundary set-back conditions are met
  • The property is not a protected structure or in an architectural conservation area
  • The site is not close to an aerodrome or subject to a specific local restriction
  • Any grant or SEAI scheme conditions you are relying on are separately satisfied

Because the specific size and percentage limits are amended periodically to keep pace with renewable energy policy, check the current wording of the relevant class or the SEAI/gov.ie guidance before finalising a panel layout.

When to check with the council

Get written confirmation from the local authority, or apply for a section 5 declaration, before installing panels on a protected structure, a large commercial-scale domestic array, or a ground-mounted system near a boundary.
