How to establish your position before applying
Take these steps to get a clear answer for your own circumstances:
- Read the rural housing chapter of the county development plan for the site's location in full
- Identify which rural area type or map designation the site falls within
- Match your personal circumstances against the specific categories the plan lists as qualifying
- Gather documentary evidence in advance — land folios, employment records, school records, electoral history
- Request a pre-planning consultation with the planning authority and ask directly whether your case meets the local needs test
- Consider a written planning opinion or engage a planning consultant to prepare a local needs statement
A pre-planning meeting is the most reliable way to get council feedback before committing to the cost of a full application and supporting reports.
If you are refused
A refusal on local needs grounds can be appealed to An Coimisiún Pleanála within the statutory appeal period, but the appeal will still be assessed against the same council policy, so new or stronger evidence of the qualifying connection is usually needed rather than simply disagreeing with the decision.
